Terms of Use Agreement

PLEASE READ THESE TERMS OF USE ("AGREEMENT" OR "TERMS OF USE") CAREFULLY BEFORE USING THE WEBSITE AND SERVICES OFFERED BY BRAVO STORE SYSTEMS, LLC ("MAXPAWN"). THIS AGREEMENT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR USE OF THE WEBSITE AT HTTP://WWW.MAXPAWN.COM (THE "SITE") AND ALL SERVICES PROVIDED BY MAXPAWN ON THE SITE.

By using the Site in any manner, including but not limited to visiting or browsing the Site, you (the "user" or "you") agree to be bound by this Agreement, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. This Agreement applies to all users of the Site, including without limitation users who are vendors, customers, and merchants, contributors of content, information and other materials or services on the Site.

1. Maxpawn is a Marketplace

Maxpawn acts as a Marketplace for its Bravo Store Systems users. It allows its users who comply with Maxpawn policies to offer and sell certain items within a fixed-price format. Maxpawn is not directly involved in the transaction between buyers and sellers. As a result, Maxpawn has no control over the quality, safety, morality or legality of any aspect of the items listed, the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to pay for items. Maxpawn cannot ensure that a buyer or seller will actually complete a transaction.

Consequently, Maxpawn does not transfer legal ownership of items from the seller to the buyer.

Maxpawn cannot guarantee the true identity, age, and nationality of a user. Maxpawn encourages you to communicate directly with potential transaction partners through the tools available on the Site.

You agree that Maxpawn is providing a venue in a Marketplace, and as such is not responsible or liable for any content, for example, data, text, information, usernames, graphics, images, photographs, profiles, audio, video, items, and links posted by you, other users, or outside parties on Maxpawn. You use the Maxpawn service at your own risk.

2. Membership Eligibility

Age: Maxpawn services are available only to, and may only be used by, individuals who are 18 years and older who can form legally binding contracts under applicable law. You represent and warrant that you are at least 18 years old and that all registration information you submit is accurate and truthful. Maxpawn may, in its sole discretion, refuse to offer access to or use of the Site to any person or entity and change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access the Site is revoked in such jurisdictions.

Individuals under the age of 18 must at all times use Maxpawns services only in conjunction with and under the supervision of a parent or legal guardian who is at least 18 years of age. In this all cases, the adult is the user and is responsible for any and all activities.

Compliance: You agree to comply with all local laws regarding online conduct and acceptable content. You are responsible for all applicable taxes. In addition, you must abide by Maxpawn policies as stated in the Agreement and the Maxpawn policy documents listed below (if applicable to your activities on or use of the Site) as well as all other operating rules, policies and procedures that may be published from time to time on the Site by Maxpawn, each of which is incorporated herein by reference and each of which may be updated by Maxpawn from time to time without notice to you:

  • Copyright and Intellectual Property Policy
  • Trademark Guidelines

In addition, some services offered through the Site may be subject to additional terms and conditions promulgated by Maxpawn from time to time; your use of such services is subject to those additional terms and conditions, which are incorporated into this Agreement by this reference.

Password: Keep your password secure. You are fully responsible for all activity, liability and damage resulting from your failure to maintain password confidentiality. You agree to immediately notify Maxpawn of any unauthorized use of your password or any breach of security. You also agree that Maxpawn cannot and will not be liable for any loss or damage arising from your failure to keep your password secure. You agree not to provide your username and password information in combination to any other party other than Maxpawn without Maxpawn’s express written permission.

Account Information: You must keep your account information up-to-date and accurate at all times, including a valid email address. To sell items on Maxpawn you must provide and maintain valid payment information such as valid credit card information or a valid PayPal account.

Account Transfer: You may not transfer or sell your Maxpawn account and User ID to another party. For Maxpawn users that are registered as a business entity, you personally guarantee that you have the authority to bind the entity to this Agreement.

Right to Refuse Service: Maxpawn services are not available to temporarily or indefinitely suspended Maxpawn members. Maxpawn reserves the right, in Maxpawn sole discretion, to cancel unconfirmed or inactive accounts. Maxpawn reserves the right to refuse service to anyone, for any reason, at any time.

3. Fees and Services

Joining and setting up a shop on Maxpawn requires being a Bravo Store System user. Maxpawn charges a flat fee for listing our users entire store inventory, as well as a percentage of the sale price when the item sells. When you list an item you have an opportunity to review and accept the fees that you will be charged. Maxpawn Fees Policy, which is subject to change, is incorporated into this Agreement by reference. Changes to the Fees Policy and the fees for Maxpawn services are effective after Maxpawn provides you with at least fourteen (14) days' notice by posting the changes on the Site. Maxpawn may, at Maxpawn’s sole discretion, change some or all of Maxpawn’s services at any time. In the event Maxpawn introduces a new service, the fees for that service are effective at the launch of the service. Unless otherwise stated, all fees are quoted in US Dollars (USD).

You are responsible for paying all fees and applicable taxes associated with using Maxpawn. Maxpawn keeps accepted payment information on file. At the beginning of the month, each seller is emailed an invoice detailing the amount due. A seller must pay the amount due in full within 15 days of the date of the invoice.

Fees and Termination: If Maxpawn terminates a listing or your account, if you close your account, or if the payment of your Maxpawn fees cannot be completed for any reason, you remain obligated to pay Maxpawn for all unpaid fees plus any penalties, if applicable. If the seller's account is not paid in full and becomes past due, the seller risks penalties such as the suspension of privileges and/or termination of the account and other collection mechanisms (including retaining collection agencies and legal counsel). If you have a question or wish to dispute a charge, contact Maxpawn.

4. Listing and Selling

Listing Description: By listing an item on the Maxpawn site, you warrant that you and all aspects of the item you post must comply with Maxpawns published policies. You also warrant that you may legally sell the item. You must accurately describe your item and all terms of sale in your Maxpawn shop. Your listings may only include text descriptions, graphics, pictures and other content relevant to the sale of that item. All items must be listed in an appropriate category with appropriate tags. Each listing must accurately and completely describe the item/items for sale in that listing. If the "in stock" quantity is more than one, all items in that listing must be identical. Each unique item must have its own listing.

Shop Policies: All sellers are required to outline shop policies for their Maxpawn shop in the Bravo Store Systems Web Configuration. These policies may include, for example, shipping, returns, payment and selling policies. Sellers must create reasonable policies in good faith and must abide by such policies. All shop policies must comply with Maxpawns site-wide policies. Sellers are responsible for enforcing their own reasonable shop policies. Maxpawn reserves the right to request that a seller modify a shop policy.

Binding Sale: All sales are binding. The seller is obligated to ship the order, allow in store pickup, or otherwise complete the transaction with the buyer in a prompt manner, unless there is an exceptional circumstance, such as: (a) the buyer fails to meet the terms of the seller's listing (such as payment method), or (b) the seller cannot authenticate the buyer's identity. The buyer is obligated to deliver appropriate payment for items purchased, unless there is an exceptional circumstance.

Fee Avoidance: The price stated in each item listing description must be an accurate representation of the sale. Sellers may charge reasonable shipping and handling fees to cover the costs for packaging and mailing the items. Sellers may not charge excessive shipping fees or otherwise avoid fees. You may not alter the item's price after a sale for the purpose of avoiding Maxpawn transaction fees, misrepresent the item's location, or use another user's account without permission.

5. Prohibited, Questionable and Infringing Items and Activities

You are solely responsible for your conduct and activities on and regarding to Maxpawn and any and all data, text, information, usernames, graphics, images, photographs, profiles, audio, video, items, and links (together, "Content") that you submit, post, and display on Maxpawn.

Restricted Activities: Your content and your use of Maxpawn shall not:

  1. Be false, inaccurate or misleading
  2. Be fraudulent or involve the sale of illegal, hazardous, counterfeit or stolen items
  3. Infringe upon any third-party's copyright, patent, trademark, trade secret or other proprietary or intellectual property rights or rights of publicity or privacy (see also Maxpawn Copyright and Intellectual Property Policy)
  4. Violate this Agreement, the Rules of Maxpawn, any site policy or community guidelines, or any applicable law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising)
  5. Contain items that have been identified by the U.S. Consumer Products Safety Commission (CPSC) as hazardous to consumers and therefore subject to a recall
  6. Be defamatory, trade libelous, unlawfully threatening, unlawfully harassing, impersonate or intimidate any person (including Maxpawn staff or other users), or falsely state or otherwise misrepresent your affiliation with any person, through for example, the use of similar email address, nicknames, or creation of false account(s) or any other method or device
  7. Be obscene or contain child pornography
  8. Contain or transmit any code of a destructive nature that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information
  9. Host images not part of a listing
  10. Modify, adapt or hack Maxpawn or modify another website so as to falsely imply that it is associated with Maxpawn
  11. Appear to create liability for Maxpawn or cause Maxpawn to lose (in whole or in part) the services of Maxpawn ISPs or other suppliers
  12. Link directly or indirectly, reference or contain descriptions of goods or services that are prohibited under this Agreement, the Privacy Policy, the Rules of Maxpawn, or other policy documents as posted on Maxpawn.

Furthermore, you may not list any item on Maxpawn (or consummate any transaction that was initiated using Maxpawn service) that, by paying to Maxpawn the listing fee or the final value fee, could cause Maxpawn to violate any applicable law, statute, ordinance or regulation, or that violates the Terms of Use.

6. Content

License: Maxpawn does not claim ownership rights in your Content. You grant Maxpawn a license solely to enable Maxpawn to use any information or Content you supply Maxpawn with, so that Maxpawn is not violating any rights you might have in that Content. You grant Maxpawn a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub licensable (through multiple tiers) right to exercise the copyright, publicity, and database rights (but no other rights) you have in the Content, in any media now known or not currently known, with respect to your Content. You agree to allow Maxpawn to store or re-format your Content on Maxpawn and display your Content on Maxpawn in any way as Maxpawn chooses. Maxpawn will only use personal information in accordance with Maxpawns Privacy Policy.

As part of a transaction, you may obtain personal information, including email address and shipping information, from another Maxpawn user. Without obtaining prior permission from the other user, this personal information shall only be used for that transaction or for Maxpawn-related communications. Maxpawn has not granted you a license to use the information for unsolicited commercial messages. Without limiting the foregoing, without express consent from the user, you are not licensed to add any Maxpawn user to your email or physical mail list. Re-Posting Content: By posting Content on Maxpawn, it is possible for an outside website or a third party to re-post that Content. You agree to hold Maxpawn harmless for any dispute concerning this use. If you choose to display your own Maxpawn-hosted image on another website, the image must provide a link back to its listing page on Maxpawn.

Idea Submissions: Maxpawn considers any unsolicited suggestions, ideas, proposals or other material submitted to it by users via the Site or otherwise (other than the Content and the tangible items sold on the Site by users) (collectively, the "Material") to be non-confidential and non-proprietary, and Maxpawn shall not be liable for the disclosure or use of such Material. If, at Maxpawn’s request, any member sends Material to improve the site (for example through the Forums or to customer support), Maxpawn will also consider that Material to be non-confidential and non-proprietary and Maxpawn will not be liable for use or disclosure of the Material. Any communication by you to Maxpawn is subject to this Agreement. You hereby grant and agree to grant Maxpawn, under all of your rights in the Material, a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, fully-paid, sub licensable and transferable right and license to incorporate, use, publish and exploit such Material for any purpose whatsoever, commercial or otherwise, including but not limited to incorporating it in the API, documentation, or any product or service, without compensation or accounting to you and without further recourse by you.

7. Information Control

Maxpawn provides access to content provided by users that is made available on Maxpawn. You may find some Content to be offensive, harmful, inaccurate, or deceptive. There are also risks of dealing with underage persons or people acting under false pretense.

Additionally, there may also be risks dealing with international trade and foreign nationals. By using Maxpawn, you agree to accept such risks and that Maxpawn (and Maxpawns officers, directors, agents, subsidiaries, joint ventures and employees) is not responsible for any and all acts or omissions of users on Maxpawn. Please use caution, common sense, and practice safe buying and selling when using Maxpawn.

Other Resources: Maxpawn is not responsible for the availability of outside websites or resources linked to or referenced on the Site. Maxpawn does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such websites or resources. You agree that Maxpawn shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or resources.

8. Resolution of Disputes and Release

In the event a dispute arises between you and Maxpawn, please contact Maxpawn.

Any dispute arising from or relating to the subject matter of this Agreement shall be finally settled by arbitration in the State of Nevada. The prevailing party in any arbitration or other proceeding arising under this Agreement shall be entitled to receive reimbursement of its reasonable expenses (including reasonable attorneys' fees, expert witness fees and all other expenses) incurred in connection therewith. Judgment upon the award so rendered may be entered in a court having jurisdiction or application may be made to such court for judicial acceptance of any award and an order of enforcement, as the case may be. Notwithstanding the foregoing, each party shall have the right to institute an action in a court of proper jurisdiction for injunctive or other equitable relief pending a final decision by the arbitrator. For all purposes of this Agreement, the parties consent to exclusive jurisdiction and venue in the United States Federal Courts or state courts located in the Clark County, Nevada. Use of the Site is not authorized in any jurisdiction that does not give effect to all provisions of the Agreement, including without limitation, this section. You and Maxpawn agree that any cause of action arising out of or related to the Site (including, but not limited to, any services provided or made available therein) or this Agreement must commence within one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred.

Should you have a dispute with one or more users, or an outside party, you release Maxpawn (and Maxpawn officers, directors, agents, subsidiaries, joint ventures and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. Maxpawn encourages users to report user-to-user disputes to your local law enforcement, postmaster general, or a certified mediation or arbitration entity, as applicable.

Maxpawn, for the benefit of users, may try to help users resolve disputes. Maxpawn does so in Maxpawn’s sole discretion, and Maxpawn has no obligation to resolve disputes between users or between users and outside parties. To the extent that Maxpawn attempts to resolve a dispute, Maxpawn will do so in good faith based solely on Maxpawn policies. Maxpawn will not make judgments regarding legal issues or claims.

9. Maxpawn Intellectual Property

MAXPAWN and other Maxpawn graphics, logos, designs, page headers, button icons, scripts, and service names are registered trademarks, trademarks or trade dress of Bravo Store Systems, LLC in the U.S. and/or other countries. Maxpawn’s trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names or email addresses, in connection with any product or service in any manner that is likely to cause confusion.

10. Access and Interference

Maxpawn may contain robot exclusion headers which contain internal rules for software usage. Much of the information on Maxpawn is updated on a real-time basis and is proprietary or is licensed to Maxpawn by Maxpawn users or third-parties. You agree that you will not use any robot, spider, scraper or other automated means to access Maxpawn for any purpose whatsoever, except to the extent expressly permitted by and in compliance with this Agreement or otherwise without Maxpawn prior express written permission. Additionally, you agree that you will not:

  1. Take any action that imposes, or may impose, in Maxpawn sole discretion, an unreasonable or disproportionately large load on Maxpawn infrastructure
  2. Copy, reproduce, modify, create derivative works from, distribute or publicly display any user Content (except for your Content) or other allowed uses as set out in the Rules of Maxpawn from the Site except to the extent expressly permitted by and in compliance with this Agreement or otherwise without the prior express written permission of Maxpawn and the appropriate third party, as applicable
  3. Interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site
  4. Bypass Maxpawn robot exclusion headers or other measures Maxpawn may use to prevent or restrict access to Maxpawn

11. Breach

Without limiting any other remedies, Maxpawn may, without notice, and without refunding any fees, delay or immediately remove Content, warn Maxpawn community of a user's actions, issue a warning to a user, temporarily suspend a user, temporarily or indefinitely suspend a user's account privileges, terminate a user's account, prohibit access to the Site, and take technical and legal steps to keep a user off the Site and refuse to provide services to a user if any of the following apply:

  1. Maxpawn suspects (by information, investigation, conviction, settlement, insurance or escrow investigation, or otherwise) a user has breached this Agreement, the Privacy Policy, the Rules of Maxpawn, or other policy documents and community guidelines incorporated herein;
  2. Maxpawn is unable to verify or authenticate any of your personal information or Content; or Maxpawn believes that a user is acting inconsistently with the letter or spirit of Maxpawn policies, has engaged in improper or fraudulent activity in connection with Maxpawn or the actions may cause legal liability or financial loss to Maxpawn users or to Maxpawn.

12. Privacy

Except as provided in Maxpawn Privacy Policy Maxpawn will not sell or disclose your personal information (as defined in the Privacy Policy) to third parties without your explicit consent. Maxpawn stores and processes Content on computers located in the United States that are protected by physical as well as technological security.

13. No Warranty

MAXPAWN, MAXPAWN SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, AND MAXPAWN SUPPLIERS PROVIDE MAXPAWN WEB SITE AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. MAXPAWN, MAXPAWN SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES AND MAXPAWN SUPPLIERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, PERFORMANCE, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IN ADDITION, NO ADVICE OR INFORMATION (ORAL OR WRITTEN) OBTAINED BY YOU FROM MAXPAWN SHALL CREATE ANY WARRANTY. SOME STATES DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE FOREGOING DISCLAIMER MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS THAT VARY FROM STATE TO STATE.

14. Liability Limit

IN NO EVENT SHALL MAXPAWN, AND (AS APPLICABLE) MAXPAWN SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES OR MAXPAWN SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER DIRECT, INDIRECT, GENERAL, SPECIAL, COMPENSATORY, CONSEQUENTIAL, AND/OR INCIDENTAL, ARISING OUT OF OR RELATING TO THE CONDUCT OF YOU OR ANYONE ELSE IN CONNECTION WITH THE USE OF THE SITE, MAXPAWN SERVICES, OR THIS AGREEMENT, INCLUDING WITHOUT LIMITATION, LOST PROFITS, BODILY INJURY, EMOTIONAL DISTRESS, OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES.

MAXPAWN LIABILITY, AND (AS APPLICABLE) THE LIABILITY OF MAXPAWN’S SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO THE GREATER OF (A) THE AMOUNT OF FEES YOU PAY TO MAXPAWN IN THE 12 MONTHS PRIOR TO THE ACTION GIVING RISE TO LIABILITY, AND (B) $100. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

15. Indemnity

YOU AGREE TO INDEMNIFY AND HOLD MAXPAWN AND (AS APPLICABLE) MAXPAWN PARENT, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, AGENTS, AND EMPLOYEES, HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING REASONABLE ATTORNEYS' FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF YOUR BREACH OF THIS AGREEMENT OR THE DOCUMENTS IT INCORPORATES BY REFERENCE, OR YOUR VIOLATION OF ANY LAW OR THE RIGHTS OF A THIRD PARTY.

16. No Guarantee

Maxpawn does not guarantee continuous, uninterrupted access to the Site, and operation of the Site may be interfered with by numerous factors outside Maxpawn control.

17. Legal Compliance; Taxes

You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of the Site and any Maxpawn service and, if applicable, your listing, purchase, solicitation of offers to purchase, and sale of items. In addition, you shall be responsible for paying any and all taxes applicable to any purchases or sales of items you make on the Site (excluding any taxes on Maxpawn net income).

18. Severability

If any provision of this Agreement is held unenforceable, then such provision will be modified to reflect the parties' intention. All remaining provisions of this Agreement shall remain in full force and effect.

19. No Agency

You and Maxpawn are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.

20. Maxpawn Service

Maxpawn reserves the right to modify or terminate the Maxpawn service for any reason, without notice, at any time. Maxpawn reserves the right to alter these Terms of Use or other Site policies at any time, so please review the policies frequently. If Maxpawn makes a material change, Maxpawn will notify you here, by email, by means of a notice on our home page, or other places Maxpawn deems appropriate. What constitutes a "material change" will be determined at Maxpawn’s sole discretion, in good faith, and using common sense and reasonable judgment.

21. Choice of Law

This Agreement shall in all respects be interpreted and construed with and by the laws of the State of Nevada, excluding its conflicts of laws rules, and the United States of America.

22. Survival

Sections 3 (Fees and Services, Fees and Termination), 6 (Content, License), 7 (Information Control), 8 (Meetings, Groups or User Fees), 9 (Resolution of Dispute and Release), 10 (Maxpawn Intellectual Property), 11 (Access and Interference), 12 (Breach), 13 (Privacy), 14 (No Warranty), 15 (Liability Limit), 16 (Indemnity), 17 (No Guaranty), 19 (Severability), 20 (No Agency), 22 (Choice of Law) shall survive any termination or expiration of this Agreement.

23. Notices

Except as explicitly stated otherwise, any notices shall be given by postal mail to Maxpawn; Attn: xxx (in the case of Maxpawn) or, in your case, to the email address you provide to Maxpawn (either during the registration process or when your email address changes). Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, Maxpawn may give you notice by certified mail, postage prepaid and return receipt requested, to the address provided to Maxpawn. In such case, notice shall be deemed given three days after the date of mailing.

24. Disclosures

The services hereunder are offered by Bravo Store Systems, LLC, located 7366 Mission Hills, Las Vegas, Nevada 89113.

Purchasing a firearm utilizing Maxpawn.com

You must register on Maxpawn.com to purchase items.

All of our sellers on Maxpawn.com are licensed FFL Holders and licensed to sell by the jurisdictions they reside in. All of the items sold on Maxpawn have submitted to the local law enforcement agencies before they are put for sale on Maxpawn.com. It is your responsibility to be in compliance with all Federal, state, and local laws when using this site.

You do not have to be a licensed dealer to buy a firearm. If you are not a licensed firearm dealer (also called an FFL Holder), you must make arrangements with the Seller to Pick Up (In Store Pickup) the firearm in person. You must make arrangements with the Seller before placing a bid on an item. By contacting the Seller before bidding, the buyer can verify that all state and federal laws will be observed. For most firearms, the buyer must be able to pass a background check.

Non-firearm items, such as air guns, knives, ammunition, antique guns that were built in 1898 or earlier firearm accessories, and some gun parts do not require transfer by a licensed dealer. There are age restrictions on many of these items, and you will be asked to verify your age to the seller (typically by mailing a photocopy of your driver's license) before you can purchase the item. In general, you must be 18 years old to buy items on this site. (To buy Pistol ammunition, you must be at least 21 years old; at least 18 years old for Rifle ammunition.)

Who is legally allowed?

Only licensed Federal Firearm dealers are allowed to sell firearms on Maxpawn.com. The following information is not intended to be a complete guide to all applicable laws. It is your responsibility to be in compliance with all Federal, state, and local laws when using this site.

What does legally allow mean? You must be an adult who is able to enter into a contract. Anyone desiring to purchase a firearm must be able to pass a background check (Click here for the ATF web site for more information). There are age limits on the sale of certain items. And certain types of items are illegal in certain places - for example 'assault weapons' cannot be sold in California and certain types of ammunition are illegal in certain states and cities. The NRA also has put together a terrific NRA guide to state-by-state gun laws. The ATF has compiled information on the various state laws; click here to view the ATF state-by-state gun laws information. Again, it is your responsibility to make sure that you comply with the laws of your country, city, and state. We do not tolerate attempted illegal activity here!

Membership

We expect all members of Maxpawn (including Maxpawn staff) to treat each other with respect and kindness. Remember that behind every username is a real person with feelings. Your username on Maxpawn is your identity. You are responsible for your conduct and all content submitted under your username on Maxpawn.

  • By joining Maxpawn, you agree to abide by all Maxpawn site-wide policies, including those outlined in these Rules of Maxpawn as well as in our Terms of Use Agreement.
  • Usernames cannot be changed except in the event of documented legal action (such as trademark infringement) at Maxpawn’s sole discretion. Choose your username carefully.
  • You may not use the word "Maxpawn" in your username without Maxpawn’s permission.
  • You must be at least 18 years of age to hold an account on Maxpawn.
    • If you are under 18, you must have the permission and supervision of a parent or legal guardian who is at least 18 years of age; that adult is responsible for the account.
  • You may not use mature, profane or racist language or images in your username, avatar and/or Public Profile.
  • You may not use the public areas of your account to demonstrate or discuss disputes with others or with Maxpawn.
  • You may not transfer ownership or sell your Maxpawn account to another party.
  • You may not use Maxpawn to direct shoppers to another online selling venue to purchase the same items as listed in your Maxpawn shop as this may constitute fee avoidance. This includes posting links/URLs or providing information sufficient to locate the other online venue(s).
  • A Maxpawn account may not be used for the purpose of redirecting traffic to another web location. Please contact Maxpawn Customer Support to have your account closed if you are no longer using it.
  • Keep your account information updated and accurate. Your account must have a valid email address at all times. Maxpawn will use the email address on file in your account information to contact you when necessary.
  • Maxpawn encourages all members to resolve their own disputes. As a venue, Maxpawn cannot mediate disputes between members or other parties.

Members who do not comply with Maxpawn’s policies may be subject to review, which can result in suspension of account privileges and/or termination. This includes all of your accounts by virtue of association. In other words, Maxpawn reserves the right to suspend the use of the site for a person and all username(s) under which he/she operates. Suspended or terminated members remain obligated to pay Maxpawn for all unpaid fees per our Terms of Use Agreement.

Multiple accounts held by one person

Having more than one account ("multiple accounts" or "alternate accounts") is not something Maxpawn encourages as it has the potential to cause confusion. Keep in mind that information and accounts cannot be merged in any way, so if you change your mind later, you will not be able to transfer information (for example: listings, feedback, Favorites or purchase history) from one account to another.

  • All of your usernames must be clearly disclosed in the Public Profile for each account. A statement such as, "I am also on Maxpawn under these usernames..." would be acceptable. This includes all buying and selling accounts, as well as any collective accounts in which you are involved.
  • You may not list the same unique item in more than one shop on Maxpawn.

Maxpawn will not issue refunds for accidental activity stemming from multiple account ownership (for example: listing items in the wrong shop). Members who do not comply with Maxpawn policies may be subject to review, which can result in suspension of account privileges and/or termination. This includes all of your accounts by virtue of association. In other words, Maxpawn reserves the right to suspend the use of the site for a person and all username(s) under which he/she operates. Suspended or terminated members remain obligated to pay Maxpawn for all unpaid fees per our Terms of Use Agreement.

Conversations

Conversations are your way to communicate privately with other Maxpawn members. Think of it like email just for Maxpawn. Conversations are primarily intended for communicating about transactions. Members may also use Conversations to build friendly relationships with one another, seek advice or discuss Maxpawn Team activities. Please use common sense when giving out personal information to others via Conversations.

  • You must not use Conversations to send unsolicited advertising or promotions, requests for donations or "spam."
  • You must not use Conversations to knowingly harass or abuse another member.
  • If someone explicitly tells you not to contact them, you must not use Conversations to contact them again, unless involved in an open transaction.
  • You must not use Conversations to interfere with a transaction.
    • You must not contact another member to buy or sell an item listed on Maxpawn outside of Maxpawn marketplace. This may also constitute fee avoidance.
    • You must not communicate with a member involved in an active or completed transaction to warn the member away from a particular buyer, seller or item.

Sending too many messages too quickly may auto-disable your Conversations. You must contact Maxpawn Customer Support to have your ability to send Conversations reinstated. Misuse of Conversations may result in suspension of account privileges and/or termination. Suspended or terminated members remain obligated to pay Maxpawn for all unpaid fees per our Terms of Use Agreement.

Transactions

Maxpawn is a Marketplace, not a retailer; Maxpawn’s role is to connect the buyer and the seller. This means when you place an order on Maxpawn, you are entering into a direct transaction and personal relationship with an individual seller (facilitated by Maxpawn). We encourage the two parties to independently work through the transaction to completion.

A transaction is created when a buyer completes the Maxpawn checkout process. The seller and buyer will receive email notifications from Maxpawn with information about the transaction and an invoice record in your Maxpawn account. A Maxpawn transaction is completed when the buyer pays and the seller may either provide in store pickup or ship the item. Payment is submitted directly to the seller via a method specified in the item listing or seller's Shop Policies (for example: PayPal, personal check, etc.).

Communication is the key to a smooth transaction. All buyer questions regarding transactions, including payment arrangements and cancellations, should be directed to the seller. Maxpawn recommends that members use Maxpawn Communications and email to correspond. Maxpawn encourages all sellers to consider customer service best practices and keep records regarding proof of shipping (for example: delivery confirmation, shipping service receipt, customs form).

Maxpawn is a global marketplace with some shops and listings available in various languages. A seller should be able to conduct business in the language used in their shop or listings (for example: if a seller creates listings in Spanish, the seller should be able to accurately describe the item, complete the transaction and provide customer service to the buyer in Mexico or Spain).

In certain circumstances, a seller may cancel an invalid or void a transaction (see Transaction cancellation) or refuse service to a buyer (see Refusing service). A seller may post important information in their Shop Announcement, Shop Policies, Public Profile or listing description to better inform buyers. A seller's individual policies for shipping, returns/exchanges and refunds posted in the seller's Shop Policies must comply with Maxpawn site-wide policies and the Terms of Use Agreement. Please note: other services involved in completing a transaction (for example: PayPal.com, shipping services) may have different policies regarding transactions.

Transaction policies for the seller:

  • The seller must sell the item(s) to the buyer with whom the transaction is created, unless the transaction is eligible for cancellation (see Transaction cancellation).
  • The seller must ship the item(s) as described (see Dissatisfaction with item or service).
  • The seller must ship the item(s) within a reasonable amount of time, according to the transaction agreement or the terms in the seller's Shop Policies.
  • The seller must ship the item(s) to the shipping address submitted by the buyer. The seller should communicate with the buyer if shipping information is unclear or inconsistent.
  • In the event of a dispute, the seller may be asked to provide Maxpawn with proof of shipping. Maxpawn will not hold the seller responsible for postal or shipping service delays or errors, theft or customs delays.

Transaction policies for the buyer:

  • The buyer must pay the seller directly. Do not send payment to Maxpawn.
  • The buyer must pay at the time the transaction is created in accordance with the transaction agreement or the terms in the seller's Shop Policies.
  • The buyer must submit valid shipping, billing and payment information to the seller in accordance with the transaction agreement or the terms in the seller's Shop Policies.
  • In the event of a dispute concerning the return of the item(s) to a seller, the buyer may be asked to provide Maxpawn with proof of shipping back to the seller. Maxpawn will not hold the buyer responsible for postal or shipping service delays or errors, theft or customs delays when returning items to the seller.

Members who do not comply with Maxpawn policies may be subject to review, which can result in suspension of account privileges and/or termination. Suspended or terminated members remain obligated to pay Maxpawn for all unpaid fees per our Terms of Use Agreement.

Transaction concerns or disputes

We hope that your shopping experience on Maxpawn is smooth and hassle-free. In the event of a transaction dispute, Maxpawn encourages the buyer and seller to resolve the situation through Maxpawn Communications, email and by submitting fair, honest feedback (see Feedback). The policies below describe various types of transaction disputes and the roles of the seller, the buyer and Maxpawn in each scenario.

Non-payment

Non-payment occurs when a buyer does not nor cannot complete payment after a transaction has been created. The seller may invoice the buyer in an attempt to collect payment before shipping. Maxpawn encourages sellers to offer buyers fair, honest feedback (see Feedback). Sellers are also encouraged to consider customer service best practices.

  • The buyer must pay at the time the transaction is created, according to the transaction agreement or according to the terms in the seller's Shop Policies.
  • The seller may cancel a transaction for non-payment when applicable (see Transaction cancellation).

Maxpawn relies on sellers to submit fair, honest feedback for buyers in non-payment circumstances. Members with a low overall feedback score may be subject to review, which can result in suspension of account privileges and/or termination. Suspended or terminated members remain obligated to pay Maxpawn for all unpaid fees per our Terms of Use Agreement.

Non-delivery

Non-delivery occurs when a seller does not or cannot ship an item after a transaction has been created and the buyer has sent payment to the seller. Maxpawn encourages all sellers to keep records regarding proof of shipping (for example: delivery confirmation, shipping service receipt, customs form). Maxpawn relies on buyers to submit fair, honest feedback (see Feedback) for sellers in non-delivery circumstances. Please note: a buyer who paid a seller via PayPal may have a limited time frame in which to file a claim for refund of purchase under PayPal's policies.

  • The seller must ship goods within a reasonable amount of time, according to transaction agreement or according to the terms in the seller's Shop Policies.
  • The seller may be asked to provide Maxpawn with proof of shipping in the event of a dispute.

A seller who fails to ship an item, respond to a non-delivery report or settle a disputed transaction in a reasonable manner may be suspended. Members who do not comply with Maxpawn policies may be subject to review, which can result in suspension of account privileges and/or termination. Suspended or terminated members remain obligated to pay Maxpawn for all unpaid fees per our Terms of Use Agreement.

Refusing service

Maxpawn encourages sellers to engage in clear and consistent communication, consider customer service best practices and honor transaction agreements. However, if a seller cannot complete a transaction due to an extraordinary circumstance, then the seller may refuse service to the buyer.

  • The seller must notify the buyer of refusal of service through email or Maxpawn Communications.
  • The seller can only refuse service prior to shipping.
  • If the buyer has already paid, then the seller must refund the buyer (price paid for the item plus shipping).
  • The seller may cancel the transaction when applicable (see Transaction cancellation).
  • Unless otherwise agreed or according to the seller's terms, a seller's refusal of service to a specific buyer is indefinite within that seller's Maxpawn shop.

Members who abuse the privilege to refuse service may be subject to review, which can result in suspension of account privileges and/or termination. Suspended or terminated members remain obligated to pay Maxpawn for all unpaid fees per our Terms of Use Agreement.

Dissatisfaction with item or service

A buyer may not be completely satisfied with a purchase or transaction experience. Maxpawn recommends that the buyer communicate with the seller by Maxpawn Communications or email to resolve the matter. Maxpawn encourages buyers to submit fair, honest feedback (see Feedback). Sellers are encouraged to consider customer service best practices.

  • The seller must accurately describe the item in the listing (see Shops and Listings).
  • The seller must comply with the transaction agreement or according to the terms in the seller's Shop Policies.

In the event the buyer receives a product that is significantly different from the original listing, the buyer may contact Maxpawn Customer Support to report the item not as described. Maxpawn relies on buyers to submit fair, honest feedback for sellers in circumstances when the buyer is dissatisfied with an item or the seller's customer service. Members who do not comply with Maxpawn policies may be subject to review, which can result in suspension of account privileges and/or termination. Suspended or terminated members remain obligated to pay Maxpawn for all unpaid fees per our Terms of Use Agreement.

Interference

To ensure the integrity of Maxpawn marketplace and help protect members from potentially fraudulent activity, transaction interference is not allowed on Maxpawn. The following circumstances are considered transaction interference:

  • You may not contact another member to buy or sell an item listed on Maxpawn outside of Maxpawn marketplace. This may also constitute fee avoidance.
  • You may not communicate with a member involved in an active or completed transaction to warn the member away from a particular buyer, seller or item.

Members who do not comply with Maxpawn policies may be subject to review, which can result in suspension of account privileges and/or termination. Suspended or terminated members remain obligated to pay Maxpawn for all unpaid fees per our Terms of Use Agreement.

Transaction cancellation

Maxpawn charges fees to sellers for use of Maxpawn services. Sellers agree to complete valid transactions and pay Maxpawn fees in full monthly and or semi-monthly. On occasion, a seller may need to cancel an invalid or void transaction. When applicable, Maxpawn will issue a refund to the seller for the applicable fees and remove the transaction from Maxpawn. Only the seller in a transaction may cancel the transaction. The buyer should contact the seller or email to request cancellation of a transaction. The buyer may contact Maxpawn Customer Support if the seller does not respond to a request to cancel a transaction. Item returns are subject to the individual seller's shop policies; the buyer needs to contact the seller for approval prior to shipping an item back to the seller.

  • The seller may not cancel a transaction for the purpose of avoiding fees or feedback.
  • The seller may cancel an invalid or void transaction, as defined by these circumstances:
    • The buyer did not pay (see Non-payment) at the time the transaction was created, according to the transaction agreement or according to the terms in the seller's Shop Policies.
    • Both the buyer and seller agree to cancel the transaction prior to shipment. If the buyer has already paid, the seller has refunded the buyer the price paid for the item plus shipping.
    • The seller has refused service to the buyer. If the buyer has already paid, the seller has refunded the buyer the price paid for the item plus shipping.
    • The buyer paid for the item(s). Although the seller shipped the item(s), the buyer did not receive the item(s). The seller has refunded the buyer the price paid for the item (at a minimum).
    • The buyer paid, the seller shipped the item, and the buyer received the item. Then the buyer and seller agreed the buyer can return the item to the seller for a refund. The seller has received the returned item, and the seller has refunded the buyer the price paid for the item (at a minimum).

Members who abuse the privilege to cancel transactions may be subject to review, which can result in suspension of account privileges and/or termination. Suspended or terminated members remain obligated to pay Maxpawn for all unpaid fees per our Terms of Use Agreement.

Feedback

Feedback is a way to establish a reputation of trust for buyers, sellers and the Maxpawn marketplace. For every transaction, the buyer and seller have the opportunity to submit a rating (positive, neutral or negative) as well as an optional comment. Both buyer and seller have the opportunity to submit feedback for up to 120 days after the date of the transaction or until the transaction is canceled by the seller (for void or invalid transactions). Consistency, fairness and honesty are critical to the integrity of the feedback system. Feedback directly affects a member's reputation, so we ask that members take it seriously.

  • Positive-rated feedback. Cannot be edited or removed after submission except as otherwise provided for in this section.
  • Negative-rated feedback may be changed to a positive rating when both parties agree.
  • After 90 days the option to leave feedback expires, this option cannot be reinstated.
  • The option to leave feedback for a canceled transaction cannot be reinstated.
  • Feedback ratings, comments or images removed by Maxpawn cannot be reinstated or resubmitted.

Members may ask Maxpawn to review feedback for removal. Contact Maxpawn Customer Support to request a feedback review. Maxpawn does not investigate the validity of opinions or statements made in feedback or mediate feedback disputes. At Maxpawn’s discretion and without notice to both parties involved, feedback may be removed or altered by Maxpawn in the following circumstances:

  • The member who submitted a negative feedback rating requests removal.
  • Personally identifying or private information was published (for example: a phone number, real name, email address, physical address, content of a private Maxpawn Communication, details regarding a Maxpawn investigation).
  • Feedback contains mature, profane or racist language and/or images.
  • Feedback contains spam, links, scripts or advertising.
  • Feedback is given for a transaction created for the sole purpose of leaving feedback.
  • Negative feedback was mistakenly submitted for a different transaction.
  • Negative feedback refers to an unrelated transaction.
  • Negative feedback comments about using Maxpawn or other services (for example: payment processors).
  • A member is confused about how to use the Feedback system, resulting in unintended negative feedback.
  • Maxpawn is provided with a valid court order requesting removal of feedback.

Members with low overall feedback scores or members who have violated the above policies for feedback may be subject to review, which can result in suspension of account privileges and/or termination. Suspended or terminated members remain obligated to pay Maxpawn for all unpaid fees per our Terms of Use Agreement.

Marketplace criteria

Maxpawn provides a marketplace for licensed businesses that utilize Bravo Store Systems.

Mature content

Maxpawn aims to maintain a marketplace appropriate for general audiences; therefore the use of mature content must comply with the following policies. Mature content is defined as visual depiction of male or female full or partial nudity, sexual activity or content, profane language or graphic violence. Item listings containing mature content must be tagged with "mature" and include the word "mature" in the item title.

  • The first thumbnail image in your item listing should be kept appropriate for general audiences; additional images in the listing may show the item in its entirety. Mature content and/or profane language or images are only allowed in the second, third, fourth and fifth photos of an item listing and the description text of a listing.
  • Pornography, as determined by Maxpawn’s sole discretion, is prohibited anywhere on Maxpawn.

Listings that do not comply with Maxpawn policies may be reported for review (see Flagging). Members who do not comply with Maxpawn policies may be subject to review, which can result in suspension of account privileges and/or termination. If Maxpawn removes an item listing for violating a Maxpawn policy, the seller is still obligated to pay the listing fee for that item. Suspended or terminated members remain obligated to pay Maxpawn for all unpaid fees per our Terms of Use Agreement.

Prohibited items

Every Maxpawn seller is responsible for following the laws that apply to you, your shop and your items, including any shipping restrictions for your items.

There are some types of items that we do not allow to be sold in the Maxpawn marketplace even if they are legal and otherwise meet Maxpawn’s selling criteria. Some things just are not in the spirit of Maxpawn. The following types of items may not be listed on Maxpawn:

  • Alcohol
  • Tobacco
  • Drugs, drug-like substances, drug paraphernalia
  • Live animals, illegal animal products
  • Pornography
  • Recalled items
  • Nazi and Nazi Related Items
  • Real estate
  • Items or listings that promote, support or glorify hatred toward or otherwise demean people based upon race, ethnicity, religion, gender, gender identity, disability, or sexual orientation, including items or content that promote organizations with such views
  • Items or listings that promote or support illegal activity or instruct others to engage in illegal activity
  • Items or listings that promote, support or glorify acts of violence or harm towards self or others

Even beyond these standards, Maxpawn members are responsible for making important moral or ethical decisions regarding what they buy and sell on Maxpawn.

We reserve the right to remove listings that we determine are not within the spirit of Maxpawn. Such listings will be removed from the site, and the member's selling privileges may be suspended and/or terminated. If Maxpawn removes an item listing for violating a Maxpawn policy, the seller is still obligated to pay the listing fee for that item. Suspended or terminated members remain obligated to pay Maxpawn for all unpaid fees per our Terms of Use Agreement.

Shops

We encourage all sellers to provide information about yourself and/or your craft in your Profile. You should explain your shop's policies regarding shipping, payments, refunds and exchanges on the Shop Policies page. You may use this space to provide additional shop policy information.

Please keep the following things in mind as you set up your shop and create listings:

  • An individual shop's policies must abide by Maxpawn site-wide policies and the Terms of Use Agreement. Maxpawn reserves the right to request that a seller provide policy information or require a seller to modify unreasonable policies at Maxpawn discretion.
  • Do not make illegal use of photographs or written text. This is in violation of our Terms of Use Agreement.
  • Use of mature, profane and/or racist language or images in the public areas of your Maxpawn shop is not permitted. This includes your username, Profile, item titles, tags, banner.
  • You may not set a minimum purchase amount requirement in your shop.
  • You must pay your Maxpawn bill on time to avoid penalties, including but not limited to suspension of listing privileges and/or account termination.
  • You may not engage in any activity to avoid Maxpawn fees ("fee avoidance"). This includes, but is not limited to, completing a transaction off-Maxpawn once it has been initiated on the site, listing an item below its intended purchase price or canceling a valid completed transaction.
  • You may not knowingly misrepresent your language. Shop and listing information should be accurate in the language(s) to which you've enrolled your shop.

Members who do not comply with Maxpawn policies may be subject to review, which can result in suspension of account privileges and/or termination. Suspended or terminated members remain obligated to pay Maxpawn for all unpaid fees per our Terms of Use Agreement.

Listings

All listings on Maxpawn should be clear, accurate and detailed. Accurate photos, descriptions and listing information are critical to selling on Maxpawn. Keep these policies in mind as you list and describe your items:

  • Listing descriptions and photos must accurately describe the item for sale so buyers know what is included in the purchase.
  • Each listing must be available for purchase.
    • You may not create a listing for an item that is not for sale or sold out.
    • A listing may not be created for the sole purpose of sharing photographs or other information with the community.
    • Items must not be listed as available for rental or lease.
  • Listing prices must be reasonable.
    • You may price an item how you choose; however, a listing should not be created with an inaccurate price in order to keep it from selling.
    • The shipping cost must be reasonable for the item.
  • Each unique item must have its own listing.
  • You may not edit a listing's information to change it to an entirely different item—this is considered fee avoidance.
  • All listings on Maxpawn must be for a tangible object. (Note: a digital file is considered a tangible object.)
  • You may not use Maxpawn to direct shoppers to another online selling venue to purchase the same items as listed in your Maxpawn shop as this may constitute fee avoidance. This includes posting links/URLs or providing information sufficient to locate the other online venue(s).
  • A listing must not be conditional upon the purchase of another listing in your shop (for example: saying "this item may only be purchased along with another item in my shop" is not allowed). This includes listings for item upgrades, shipping upgrades and gift wrapping upgrades.
  • Gift certificates are governed by local laws; it is the seller's responsibility to determine if they are in compliance. If you list a gift certificate on Maxpawn, you are responsible for this compliance.
    • You must include this sentence in the item listing: "This Gift Certificate is valid only in my Maxpawn shop, and it is only redeemable here."
  • Drop shipping is not permitted. All items must be shipped under the direct supervision of the seller.

Listings that do not comply with Maxpawn policies may be reported for review (see Flagging). Members who do not comply with Maxpawn policies may be subject to review, which can result in suspension of account privileges and/or termination. If Maxpawn removes an item listing for violating a Maxpawn policy, the seller is still obligated to pay the listing fee for that item. Suspended or terminated members remain obligated to pay Maxpawn for all unpaid fees per our Terms of Use Agreement.

Labeling your items

There are several key pieces of information about your item that Maxpawn uses to help shoppers find what they are seeking, such as titles, tags, attributes, materials, categories and subcategories. It's very important to accurately label your items. Providing high-quality, accurate information helps shoppers find your items. Inaccurate information can create a frustrating shopping experience for everyone in the marketplace.

Here are the basic rules for labeling your listings:

  • Only use accurate and relevant terms that describe the specific item for sale in your listing.
  • Answers to "Who made it?", "What is it?" and "When was it made?" must be accurate; this information determines the categories available for your listing.
  • You may use relevant synonyms (for example: a purse may be described as a "handbag"). However, you must not label a listing with related, but inaccurate words (for example: mittens should not be described as "scarf," earrings should not be described as "necklace").
  • You cannot use any words or description in connection with describing or promoting the item that would constitute false advertising.
  • If your items are one-of-a-kind or unique, you may describe your listing as "original," "OOAK," "one of a kind," or other synonyms. However, if your item is a reproduction or in an edition of multiples, you must not describe it with these terms.
  • You may use a short descriptive phrase as a tag if it accurately describes your item.
  • If your listing contains mature content, then you must comply with Maxpawn mature content policies. This includes tagging and titling your listing with the word "mature."

Flagging

It's your way to alert Maxpawn of potential problems. Use the "Report this item to Maxpawn" link on any item listing page. This is a confidential process. The member whose listing is reported will not know who flagged it. Additionally, Maxpawn investigation will be handled privately; you will not receive a personal response to your flagging message.

  • Flagging should be used to report any item listing or shop request that violates any of Maxpawn policies.
  • Do not flag a single violation multiple times.
  • Do not flag for intellectual property matters. Instead, please follow Maxpawn Copyright and Intellectual Property Policy.

In most cases, Maxpawn will work with a member privately to remedy the problem. If a seller does not respond to Maxpawn communication or requests in a timely manner, the item may be removed, and the shop's selling privileges may be suspended and/or terminated. In some extreme cases, listings will be removed immediately. Abuse of the flagging system by means of raising repeated, unjustified flags may result in the suspension and/or termination of your account. If Maxpawn removes an item listing for violating a Maxpawn policy, the seller is still obligated to pay the listing fee for that item. Suspended or terminated members remain obligated to pay Maxpawn for all unpaid fees per our Terms of Use Agreement.

The Maxpawn Blog

On The Maxpawn Blog we publish new articles — sharing stories, videos, seller tips and shopping finds from the Maxpawn marketplace. Maxpawn staff, special guests and members of the Maxpawn community contribute posts on a variety of topics. We'd love to hear your story.

  • We encourage members to share their opinions, including disagreement with ideas presented on the blog. The tone should be civil and respectful, and the discussion remains on-topic.
  • Knowingly harassing, insulting or abusing other members is unacceptable in blog comments. Constructive criticism is fine, but being mean is not.
  • Mature, profane or intolerant language is not permitted in blog comments.
  • Maxpawn does not allow spam in blog comments; for this reason, unsolicited promotion or advertisement from representatives or affiliates of outside services, websites or other products is not allowed.

Maxpawn reserves the right to remove blog comments. Posting inappropriate comments may result in suspension of privileges and/or account termination.

The Billing Fees

Billing fees fall into 2 categories:

  1. Insertion fee
  2. Success fee – Final value fee

Insertion fee is included when you opt in as an eCommerce seller on the Bravo Store Systems Web Configuration. The monthly fee includes unlimited number of items, unlimited number of images, and the complete selling management process and managements solutions.

Success fee – Final value fee: if the item sells, you're charged a final value fee. The final value fee is based on the item's total cost to the buyer. The item's total cost to the buyer is the item price (less any sales tax).
